As part of the Rule of Law Programme for the Western Balkans, the AIRE Centre hosted a seminar on Article 5 of the European Convention on Human Rights. The event was hosted in Sarajevo, Bosnia and Herzegovina for legal advisors to the highest courts in BiH.

Sarajevo 21 June 2016 

On the 21 June 2016 the AIRE Centre from London and the Judicial Training Centre of the Federation of Bosnia and Herzegovina organised a seminar for the senior advisors and lawyers of the Court of Bosnia and Herzegovina and the Constitutional Court of Bosnia and Herzegovina. 25 judges and advisors of both courts participated in the event. The event was held in the Radon Plaza in Sarajevo.

The event is part of the collaborative project to ‘Strengthen the Judiciary of Bosnia and Herzegovina for EU Integration’ (the project), and is implemented by the AIRE Centre and funded by the British Embassy in Sarajevo, Bosnia and Herzegovina (BiH).

The project is expected to contribute to the rule of law reform in BiH as part of its European Union integration process, by addressing weaknesses in the judicial system identified in the 2015 European Commission Progress Report, by building the capacity of the judicial training institution, and by assisting the authorities in BiH to ensure that its judiciary meets European standards. The project has a particular focus on the national implementation of the European Convention on Human Rights (ECHR).

The aim of this seminar was to bring together Bosnia and Herzegovina’s Courts to meet and discuss reforms necessary for European integration. The topic of this seminar was Detention and the European Convention on Human Rights and its equivalent national provisions and practice.

Main presentations and discussions included an overview of background and key concepts of Article 5 of the Convention. The guarantees contained in Article 5 of the ECHR with particular focus on ordering detention and considering other alternatives such as bail. Necessary grounds for extending detention, and the right to challenge lawfulness of pre-trail detention. Discussions where focused on ensuring proper implementation of international standards in BiH.
